This Warranty Policy applies to eligible shipping containers sold by AGM Container and Towing Service (“AGM”, “we”, “our” or “us”).
AGM supplies different types of shipping containers in various sizes, conditions, and configurations, including:

Refurbished Shipping Containers
Refrigerated Shipping Containers
Insulated Shipping Containers
Office Containers
Offshore Containers
Site Office Containers
Modified or Converted Containers
This Warranty Policy explains the voluntary commercial warranty that may apply to eligible containers purchased through our website. The applicable warranty coverage depends on the container’s condition, type, configuration, components, and the terms that apply to the product purchased.
This Warranty Policy operates alongside our Terms & Conditions, Returns & Refund Policy, and applicable Australian Consumer Law.
Nothing in this Warranty Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot legally be excluded, restricted, or modified under Australian Consumer Law.
1. Warranty Coverage
Subject to the terms of this policy, AGM provides the following limited commercial warranty for eligible containers:

The warranty period begins on the date the container is delivered to the customer.
The commercial warranty applies to the eligible container purchased from AGM and covers eligible defects in accordance with this policy.
The applicable warranty coverage depends on the product purchased, its condition, configuration, and the components expressly included in the sale. Depending on the product, this may include the container structure, doors, flooring, insulation, refrigeration equipment, office-related fittings, modifications, conversions, or other supplied components where the applicable warranty terms provide coverage.
Customers should review the individual product listing, invoice, and any written warranty information to understand the specific coverage applicable to their purchase.
For refurbished containers, the applicable warranty coverage depends on the individual product’s condition, refurbishment work, included components, and any product-specific warranty terms. Refurbishment does not automatically mean that every container has the same warranty coverage or that all components have identical coverage.
The warranty period is determined by the condition of the container stated in the applicable product listing or purchase documentation. The warranty does not automatically provide the same coverage for every container type, component, accessory, modification, or conversion.
2. Refrigerated, Insulated, Office, Offshore, Site Office, and Modified or Converted Containers
AGM supplies different types of shipping containers, including refrigerated, insulated, office, offshore, site office, modified, and converted containers.
These products may have different designs, configurations, fittings, equipment, structural features, and additional components depending on the individual product.
The applicable warranty depends on the product purchased, its condition, the components included in the sale, and the terms of this policy and any applicable written warranty information.
2.1 Refrigerated Shipping Containers
A refrigerated shipping container may include the container structure, doors, insulation, refrigeration equipment, and other associated components, depending on the individual product purchased.
The commercial warranty covers eligible defects affecting the container and the refrigeration equipment supplied with it, only to the extent specified in the applicable product listing, invoice, and written warranty terms. Coverage is subject to the applicable warranty period, the terms of this policy, and the exclusions set out in Section 5.
Coverage may depend on the condition of the refrigeration equipment, its included components, the specifications of the individual product, and any applicable exclusions.
The applicable warranty period is determined by the container’s condition and the warranty periods stated in Section 1. The warranty begins on the delivery date.
The warranty covers eligible defects affecting the refrigeration equipment and the container, provided that the issue falls within the coverage of this policy and is not caused by an excluded circumstance.
The warranty does not automatically guarantee a specific cooling performance, temperature range, temperature retention, or suitability for a particular purpose unless that performance or suitability is expressly stated in the applicable product description, invoice, or written warranty terms.
Customers should review the individual product description, invoice, and written warranty information for details about the refrigeration equipment supplied, its stated specifications, and the applicable warranty coverage.
Nothing in this section limits any rights or remedies available to customers under applicable Australian Consumer Law.
2.2 Insulated Shipping Containers
An insulated shipping container may include insulated panels and other insulation-related components, depending on the individual product purchased.
The commercial warranty covers eligible defects affecting the container structure, insulated panels, and other covered insulation-related components supplied with the container. Coverage is subject to the applicable warranty period, the terms of this policy, and the exclusions set out in Section 5.
The insulated panels and other insulation-related components supplied with an eligible insulated container are covered only to the extent specified in the applicable product listing, invoice, and written warranty terms. Coverage may depend on the condition of the components, the materials supplied, and any applicable exclusions.
The applicable warranty period is determined by the container’s condition and the warranty periods stated in Section 1. The warranty begins on the delivery date.
The warranty covers eligible defects affecting the insulated panels, other covered insulation-related components, and the container, provided that the issue falls within the coverage of this policy and is not caused by an excluded circumstance.
The warranty does not automatically guarantee a specific level of insulation performance, temperature retention, energy efficiency, or suitability for a particular purpose unless that performance or suitability is expressly stated in the applicable product description, invoice, or written warranty terms.
Insulation performance may depend on factors such as the condition of the container, the insulation materials supplied, the condition of the panels and components, and the intended use of the container. Customers should review the individual product description, invoice, and written warranty information for details about the insulation-related components supplied and any specific performance information provided.
Nothing in this section limits any rights or remedies available to customers under applicable Australian Consumer Law.
2.3 Office Containers and Site Office Containers
Office containers and site office containers may include additional features, fittings, fixtures, or components depending on the individual product.
These features may include office-related fittings, doors, windows, insulation, electrical components, flooring, or other items, where applicable to the product purchased.
The commercial warranty covers eligible defects affecting the container and any components expressly covered under the applicable warranty terms.
Coverage for additional fittings, fixtures, electrical components, insulation, and other office-related features depends on the product listing, invoice, written warranty terms, or separate agreement applicable to the purchase.
Customers should review the individual product listing and purchase documentation to confirm the features included with the container and the applicable warranty coverage.
The warranty does not automatically guarantee that an office container or site office container is suitable for every intended use, location, installation method, workplace arrangement, or regulatory requirement unless that suitability is expressly stated in the applicable product information or written warranty terms.
2.4 Offshore Containers
Offshore containers may have specific configurations, components, and intended applications depending on the individual product.
The applicable warranty coverage depends on the container’s condition, configuration, supplied components, product description, invoice, and written warranty terms.
The commercial warranty covers eligible defects affecting the container and any components expressly covered under the applicable warranty terms.
Customers should review the individual product listing and written documentation to confirm the container’s specifications, configuration, condition, intended use, and any applicable limitations before purchase.
AGM does not automatically represent that every offshore container has the same certification, rating, configuration, or suitability for a particular offshore, marine, lifting, transport, or industrial application. Any specific representation must be confirmed in the applicable product documentation.
2.5 Modified or Converted Containers
Modified or converted containers may include changes to the original container design, structure, access points, fittings, equipment, or internal configuration.
The commercial warranty covers eligible defects affecting the container and any modifications, conversions, or components expressly covered under the applicable warranty terms.
The coverage applicable to a modified or converted container depends on the specific product, the work carried out, the components supplied, the product description, the invoice, and any written warranty terms.
Customers should review the individual product listing and purchase documentation to understand the modifications or conversions included with the container.
The warranty does not automatically guarantee that every modification or conversion is suitable for all intended applications, locations, installation methods, operating environments, or regulatory requirements unless that suitability is expressly stated in the applicable product information or written warranty terms.
2.6 Refurbished Shipping Containers
Refurbished shipping containers are previously used containers that have undergone refurbishment. The work completed and the resulting condition may vary depending on the individual container, its previous use, and the refurbishment work performed.
The commercial warranty for an eligible refurbished container applies according to the warranty period stated in Section 1 and the applicable terms of this policy.
The warranty covers eligible defects affecting the container and any components expressly covered under the applicable warranty terms. The scope of coverage depends on the individual product, the refurbishment work completed, the components supplied, and any written warranty information provided with the purchase.
Refurbishment does not automatically mean that every component has been replaced, repaired, renewed, or restored to a new condition. Customers should review the individual product listing and purchase documentation for available information about the refurbishment work, stated condition, specifications, and included components.
Signs of previous use or cosmetic imperfections that are consistent with the disclosed condition of the container do not necessarily constitute a warranty defect. However, any rights or remedies available under applicable Australian Consumer Law are not limited by this provision.
Customers should contact AGM if they identify an issue that they believe is covered by the applicable commercial warranty or consumer guarantees.
2.7 Separate Equipment and Components
Where a container is sold with additional equipment, accessories, fittings, modifications, conversions, or other components, customers should confirm whether those items:
Are included in the container’s standard commercial warranty.
Have separate warranty terms.
Are covered by a manufacturer or supplier warranty.
Are excluded from the standard commercial warranty.
Are subject to specific conditions or limitations.
Coverage for additional equipment or components will be determined by the applicable product listing, invoice, written warranty terms, or separate agreement.
AGM will identify any specific warranty terms or limitations communicated to the customer for additional equipment or components, where applicable.
Nothing in this section limits any rights or remedies that cannot legally be excluded under Australian Consumer Law.
3. What the Warranty Covers
Subject to the applicable warranty terms and exclusions in this policy, the commercial warranty covers eligible defects affecting the container or covered components that materially affect the container’s structural integrity, intended use, or covered functionality, and that were not disclosed to the customer before purchase.
Depending on the product purchased and the coverage expressly provided, eligible issues may include:
Significant structural defects covered under this policy.
Significant holes or defects that materially affect the container’s intended use.
Doors that do not function properly because of an eligible defect that existed at the time of delivery.
Other eligible material defects that were present at the time of delivery and fall within the coverage of this warranty.
Eligible defects affecting refrigeration equipment, insulated panels, or other components expressly covered under the applicable product listing, invoice, or written warranty terms.
For refrigerated, insulated, office, offshore, site office, modified, or converted containers, the assessment of a warranty claim will depend on the specific product, its configuration, the components supplied, the disclosed condition, and the applicable warranty terms.
A defect or condition specifically disclosed to the customer before purchase will be considered when assessing a warranty claim.
For used and refurbished containers, reasonable signs of previous use or cosmetic imperfections that are consistent with the disclosed condition are not necessarily warranty defects.
Nothing in this section limits any rights or remedies available to customers under applicable Australian Consumer Law.
4. Used Container Condition
Used shipping containers may have reasonable signs of previous use, including:
Surface rust.
Minor dents.
Scratches.
Paint deterioration.
Cosmetic marks.
Minor imperfections.
These conditions do not necessarily constitute a warranty defect where they are consistent with the advertised condition of the container.
Any material condition or defect specifically disclosed before purchase will be considered when assessing a warranty claim.
For used refrigerated or insulated containers, the condition and age of the refrigeration equipment, insulation, and other components should be considered in accordance with the information provided in the relevant product listing or written agreement.
For used office, offshore, site office, modified, or converted containers, the condition of the container and any supplied fittings, equipment, modifications, or conversions should be considered in accordance with the applicable product listing and purchase documentation.
5. What the Warranty Does Not Cover
Unless required otherwise by applicable law, the commercial warranty does not cover damage or problems caused by:
Normal wear and tear.
Cosmetic deterioration.
Minor dents or scratches.
Surface rust consistent with the container’s age or condition.
Misuse or improper use.
Negligence.
Accidental damage occurring after delivery.
Improper handling.
Improper transportation after delivery.
Unauthorised modifications or alterations.
Welding, cutting, or structural changes made after delivery.
Improper installation or placement.
Failure to maintain the container or applicable equipment appropriately.
Damage caused by third parties after delivery.
Environmental conditions occurring after delivery where not attributable to a covered defect.
Damage caused by circumstances outside AGM’s reasonable control.
For refrigerated containers, refrigeration equipment, cooling systems, electrical controls, and other refrigeration-related components supplied with the container are covered only to the extent specified in the applicable product listing, invoice, and written warranty terms. Coverage may depend on the condition of the equipment, the components included in the sale, the applicable warranty terms, and any exclusions in this policy. The warranty does not automatically guarantee a specific cooling performance, temperature range, temperature retention, or suitability for a particular purpose unless expressly stated in the applicable product information or written warranty terms.
For insulated containers, insulated panels and other insulation-related components supplied with the container are covered only to the extent specified in the applicable product listing, invoice, and written warranty terms. Coverage may depend on the condition of the components, the materials supplied, the applicable warranty terms, and any exclusions in this policy. The warranty does not automatically guarantee a specific level of insulation performance, temperature retention, energy efficiency, or suitability for a particular purpose unless expressly stated in the applicable product information or written warranty terms.
For office, offshore, site office, modified, and converted containers, additional fittings, fixtures, equipment, and components are covered only to the extent specified in the applicable product listing, invoice, written warranty terms, or separate agreement.
Any specific exclusions applicable to refrigeration equipment, insulated panels, electrical components, office fittings, offshore-related features, modifications, conversions, or other additional equipment will be determined by the relevant written warranty terms and the exclusions in this policy.
These exclusions do not limit any rights the customer may have under Australian Consumer Law.
6. Warranty Claims
Customers who believe their container or covered equipment has a defect covered by this Warranty Policy should contact AGM as soon as reasonably practicable after discovering the issue.
To help us investigate the claim, customers should provide:
Full name.
Order or invoice number.
Proof of purchase.
Description of the issue.
Photographs or videos showing the alleged defect.
Delivery details.
Any other information reasonably requested to assess the claim.
For refrigerated containers, customers may also be asked to provide relevant information about the refrigeration equipment and the issue being reported.
For office, offshore, site office, modified, and converted containers, customers may be asked to provide information about the relevant fittings, components, modifications, conversions, or other features connected to the claim.

We may request additional information or arrange an inspection before determining whether the issue is covered.
Customers should not dispose of, remove, alter, repair, or modify the affected component in a way that prevents a reasonable assessment of the claim without first contacting AGM, except where immediate action is reasonably necessary to prevent further damage or protect safety.
7. Inspection
AGM may reasonably require an inspection of the container or relevant equipment before approving a commercial warranty claim.
The inspection may be carried out by:
AGM.
A transport or service provider acting on our behalf.
Another appropriately qualified person or service provider.
For refrigerated containers, the inspection may involve assessing the container structure, refrigeration equipment, or other relevant components, depending on the nature of the claim.
For insulated containers, the inspection may involve assessing the container structure, insulated panels, or other relevant insulation-related components.
For office, offshore, site office, modified, and converted containers, the inspection may involve assessing the container structure, fittings, equipment, modifications, conversions, or other components relevant to the claim.
Customers must not make structural modifications or repairs that could affect the assessment of the alleged defect without first contacting AGM, except where immediate action is reasonably necessary to prevent further damage or protect safety.
An inspection does not automatically mean that a warranty claim has been approved. Coverage will be determined after reviewing the relevant information, the applicable warranty terms, and the circumstances of the claim.
8. Warranty Resolution
If AGM determines that a valid commercial warranty claim exists, AGM will assess the appropriate resolution based on the nature of the issue, the applicable warranty terms, the condition of the container or component, practical circumstances, and applicable law.
Depending on the circumstances, AGM may:
Repair the container or covered component.
Replace the affected container or provide an equivalent replacement, subject to availability.
Arrange an appropriate repair or other remedy for covered equipment.
Provide a refund or another appropriate remedy where required by the applicable warranty terms or law.
Where a remedy is required under Australian Consumer Law, the customer’s statutory rights will apply.
AGM will explain the proposed warranty resolution to the customer where reasonably practicable.
A repair, replacement, refund, or other remedy provided under this commercial warranty does not limit any consumer guarantee or other statutory right that cannot legally be excluded.
9. Transport and Related Costs
Because shipping containers are large and require specialised transportation, warranty-related transportation may involve additional logistics and costs.
Where AGM confirms that a defect is covered by this commercial warranty, AGM will assess and, where applicable, arrange or cover reasonable transportation, inspection, repair, or other costs associated with the approved warranty remedy, subject to the applicable warranty terms and law.
Customers should contact AGM before arranging chargeable transportation, inspection, repair, or other services relating to a warranty claim, unless immediate action is reasonably necessary to protect safety or prevent further damage.
If a customer incurs expenses that AGM is required to reimburse under the applicable warranty terms or law, the customer should provide reasonable supporting documents, such as receipts, invoices, and details of the expense. AGM will explain the applicable reimbursement process.
Where a claim is determined not to be covered by this commercial warranty, the customer may be responsible for costs associated with unnecessary transportation, inspection, or other services where those costs were disclosed or agreed in advance.
AGM will explain any applicable costs to the customer before arranging chargeable transportation, inspection, or other services, where reasonably practicable.
Nothing in this section limits any rights or remedies that cannot legally be excluded under Australian Consumer Law.
10. Warranty Period
The commercial warranty applies during the applicable warranty period specified in Section 1, unless a separate warranty expressly applies to a particular component or equipment.
The warranty period begins on the date the container is delivered to the customer.
The warranty period does not restart following a repair or replacement unless AGM expressly agrees otherwise or applicable law requires otherwise.
The expiry of the commercial warranty period does not automatically remove or limit any consumer guarantee or other statutory right that may apply under Australian Consumer Law.
AGM will assess any claim according to the applicable warranty period, the date the issue arose or was identified, the terms of this policy, and applicable law.
11. Customer Responsibilities
Customers should:
Inspect the container as soon as reasonably practicable after delivery.
Notify AGM promptly if they identify a potential defect.
Provide reasonable information and evidence to assist with a warranty investigation.
Use and maintain the container and applicable equipment appropriately.
Avoid unauthorised structural modifications.
Follow reasonable instructions provided by AGM regarding inspection or warranty assessment.
Review and follow any relevant operating, maintenance, handling, or installation instructions provided with the container or its components.
Confirm that the container is suitable for the intended application before purchase and use.
For refrigerated containers, customers should follow any relevant operating, maintenance, and handling instructions provided with the refrigeration equipment.
For office, offshore, site office, modified, and converted containers, customers should follow any relevant instructions relating to the supplied fittings, equipment, modifications, conversions, or other components.
Prompt notification helps AGM investigate and resolve issues efficiently.
However, failure to notify AGM within a particular timeframe does not automatically remove or reduce any rights or remedies available under Australian Consumer Law.
12. Australian Consumer Law
This commercial warranty is provided in addition to, and does not replace, the consumer guarantees and other rights available under Australian Consumer Law where applicable.
Consumer guarantees apply automatically in accordance with the law and cannot be removed or limited by this commercial warranty. Depending on the circumstances, consumers may have rights to a repair, replacement, refund, cancellation, or other remedy where a product does not meet applicable consumer guarantees.
Nothing in this Warranty Policy is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that cannot legally be excluded, restricted, or modified.
Mandatory consumer guarantee wording:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The mandatory wording above is required for applicable warranties against defects for the supply of goods. The warranty document must also contain the required business details, warranty period, claim procedure, and information about expenses associated with making a claim.
13. No Automatic Warranty for Modifications
If a customer modifies, cuts, welds, converts, or structurally alters a container after delivery, AGM may be unable to determine whether a subsequent problem resulted from the original condition of the container or the modification.
Accordingly, damage or defects caused by unauthorised modifications may not be covered by this commercial warranty.
Unauthorised modifications may include structural cutting, welding, alterations to doors or openings, changes to flooring, installation of equipment, or other changes that affect the container or its components.
This section does not automatically exclude coverage for a defect that is unrelated to the customer’s modification or alteration.
This section does not affect any statutory rights that cannot legally be excluded.
14. Relationship With Returns & Refund Policy
This Warranty Policy is separate from AGM’s 30-day Returns & Refund Policy.
The 30-day change-of-mind return period applies according to the conditions contained in the Returns & Refund Policy.
A warranty claim concerns an alleged defect or failure covered by this Warranty Policy or applicable consumer guarantees.
A return or refund request may be assessed under the Returns & Refund Policy, this Warranty Policy, applicable product terms, or Australian Consumer Law, depending on the circumstances.
Customers should contact AGM if they are uncertain whether an issue should be handled as a return, refund request, or warranty claim.
Nothing in this section limits any rights or remedies available under Australian Consumer Law.
15. No Transfer
Unless otherwise agreed in writing or required by applicable law, this commercial warranty applies to the original purchaser and is not automatically transferable to another person following the resale or transfer of the container.
This provision does not limit any rights that apply under Australian law.

We may update this Warranty Policy from time to time.
Any updated version will be published on this page with a revised “Last updated” date.
Changes to this policy will not retrospectively remove or reduce rights that customers have already acquired or that cannot legally be excluded.
