This Returns & Refund Policy applies to purchases made from AGM Container and Towing Service (“we”, “our”, “us”) through our website.
 
We aim to provide clear and transparent information about returns, refunds, exchanges and remedies for shipping containers and related products purchased from us.
 
Nothing in this policy excludes, restricts or modifies any rights or remedies available to consumers under the Australian Consumer Law (ACL).
 
1. General Information
 
Our products include shipping containers and related container products. Due to their size, weight and specialised transportation requirements, approved returns cannot normally be made through ordinary parcel or courier services.
 
Where a return is approved, the container must be collected or transported using appropriate heavy transport equipment.

2. 30 Day Change of Mind Returns

We accept eligible change of mind returns within 30 days from the date the container is delivered.

A change of mind return is a voluntary return where the customer no longer wants the product or has changed their decision to purchase. This policy is separate from any rights and remedies available under the Australian Consumer Law.

To qualify for a change of mind return:

• The return request must be submitted within 30 days of delivery.

• The container must be in substantially the same condition as when it was delivered.

• The container must not have been modified, altered, painted, repaired or structurally changed.

• The container must not have been permanently installed or incorporated into another structure.

• The container may only have been reasonably inspected to determine whether it is suitable.

• Proof of purchase must be provided.

• The container must be reasonably accessible for collection by suitable transport equipment.

Change of mind returns are subject to the conditions described in this policy.

3. Return Costs for Change of Mind Returns

For an eligible change of mind return, the customer is responsible for the reasonable costs of returning or arranging collection of the container.

These costs may include:

• Heavy transport or collection costs

• Loading or handling costs

• Crane or lifting charges, where required

• Additional transport costs resulting from difficult site access

• Other reasonable logistics costs directly associated with the return

The customer is responsible for paying the applicable return or collection costs for an eligible change of mind return, unless otherwise required by law.

Because the cost of returning a shipping container can vary depending on the customer’s location, site access and transport requirements, AGM will advise the customer of the applicable return or collection costs before the return is arranged.

The customer is not required to independently arrange transport before receiving return instructions from us.

Original Delivery Fee
 
For an eligible change of mind return, the original delivery fee of AUD $400 is non refundable, except where otherwise required by law.

This means that the delivery fee originally paid to have the container delivered to the customer will not be included in the refund for a change of mind return, except where otherwise required by law.

The customer is also responsible for the applicable reasonable return or collection costs associated with the change of mind return.

4. Returns Required Under Australian Consumer Law
 
The customer responsibility provisions for change of mind returns do not limit or exclude any rights or remedies available under the Australian Consumer Law.
 
If a container is faulty, damaged, incorrect, significantly different from its description, or otherwise fails an applicable consumer guarantee, the customer’s rights will be assessed under the Australian Consumer Law.
 
Where the Australian Consumer Law requires AGM Container and Towing Service to provide a remedy, including any applicable return, collection, transport or related costs, those legal requirements will apply.
 
This means that the customer will not be responsible for return or collection costs where applicable law requires AGM to cover those costs.
 
Our 30 day change of mind return period does not reduce or replace any statutory rights that may apply under the Australian Consumer Law.
 
5. Change of Mind Return Process
 
Customers must contact us before arranging or attempting to return a container.
 
To request a change of mind return, please provide:
 
• Full name
 
• Order number
 
• Date of purchase
 
• Delivery date
 
• Reason for the return
 
• Photographs of the container, where requested
 
• Collection location and access information
 
We will review the request and, where the return meets the conditions of this policy, provide the customer with return instructions and coordinate the appropriate collection or transport process.
 
Do not arrange transport or move the container to another location before receiving return instructions from us.
 
6. Return Method
 
Shipping containers cannot be returned through ordinary parcel or courier services.
 
Approved returns must be collected using appropriate heavy transport equipment, which may include:
 
• Tilt tray trucks
 
• Side loader trucks
 
• Crane trucks
 
• Other suitable specialised transport
 
The customer must ensure that the container remains reasonably accessible and that the collection location is suitable for the required transport equipment.

Depending on the circumstances and location of the container, we may provide alternative collection instructions.
 
7. No Standard Restocking Fee
 
We do not charge a standard restocking fee for eligible returns.
 
However, for eligible change of mind returns, reasonable return, collection, transport or handling costs may be deducted from the refund where those costs are the customer’s responsibility under this policy.
 
Any applicable deductions will be communicated to the customer.
 
8. Condition of Returned Containers
 
A container returned under the change of mind policy must be in substantially the same condition as when delivered.
 
A change of mind return may be affected if the container has:
 
• Been modified or structurally altered
 
• Been painted or permanently changed
 
• Been damaged after delivery
 
• Been used beyond reasonable inspection
 
• Had components removed
 
• Been relocated without authorisation where this affects collection
 
• Been subjected to conditions that cause additional damage
 
Where damage or loss has occurred after delivery and is the customer’s responsibility, reasonable costs associated with the damage or loss may be deducted from the refund where permitted by law.
 
These conditions apply to voluntary change of mind returns and do not affect rights available under the Australian Consumer Law.
 
9. Faulty, Damaged or Misdescribed Containers
 
If your container arrives with a defect, damage, incorrect specification, significant issue or other problem that was not disclosed before purchase, please contact us as soon as reasonably possible.
 
We may request photographs, videos, delivery information or other evidence to help us assess the issue.
 
Depending on the circumstances and your rights under the Australian Consumer Law, an appropriate remedy may include:
 
• Repair
 
• Replacement
 
• Refund
 
• Partial refund
 
• Another appropriate remedy required by law
 
We will assess the issue and provide the remedy required under applicable law.
 
10. Damage or Incorrect Delivery
 
If the container delivered to you is:
 
• Damaged
 
• Incorrect
 
• Significantly different from its description
 
• Missing an important component
 
• Otherwise affected by an issue that may constitute a failure under the Australian Consumer Law
 
please contact us as soon as reasonably possible after delivery.
 
Where possible, provide:
 
• Order number
 
• Photographs of the container
 
• Photographs of visible damage
 
• Description of the issue
 
• Relevant delivery documentation
 
We will investigate the matter and determine the appropriate resolution.
 
Reporting delivery related damage within  48 hours is strongly recommended because it allows us to investigate the condition of the container at the time of delivery. However, this reporting request does not remove or reduce any rights you may have under the Australian Consumer Law.
 
11. Australian Consumer Law
 
Nothing in this policy excludes, restricts or modifies any consumer guarantees, rights or remedies that cannot legally be excluded under the Australian Consumer Law.
 
Where a container does not meet an applicable consumer guarantee, you may be entitled to a remedy depending on the nature and seriousness of the problem.
 
For example, where there is a major failure, you may have rights to a refund or replacement. Where there is a minor failure, we may be required to provide an appropriate remedy such as repair.
 
Our 30 day change of mind policy is separate from these statutory rights.
 

12.Refunds

Once an approved return has been received and inspected, we will assess the returned container.

Where a refund is approved, it will generally be issued to the original payment method.

We aim to process approved refunds within 5 to 10 business days after the return has been received and the applicable inspection has been completed.

The time required for the refund to appear in your account may depend on your bank or payment provider.

Change of Mind Refunds

For an eligible change of mind return, the refund will exclude the original delivery fee paid by the customer.

The customer is also responsible for the reasonable return or collection costs associated with the change of mind return.

Any applicable deductions or costs will be communicated to the customer before the return is arranged.

Where applicable, the refund may also be adjusted for reasonable additional logistics costs or damage caused after delivery for which the customer is responsible, where permitted by law.

Nothing in this section limits any refund or other remedy required under the Australian Consumer Law.

 
13. Exchanges and Replacements
 
We may provide an exchange or replacement where appropriate and where the required container is available.
 
Exchanges or replacements may be considered where:
 
• The wrong container was supplied
 
• A container has a verified defect
 
• A container was significantly different from its description
 
• Another remedy is required under applicable consumer law
 
Availability of replacement containers may depend on current stock.
 
Where a replacement is not reasonably available, another appropriate remedy may be provided.
 
14. Non Returnable Situations for Change of Mind Returns
 
A change of mind return may not be accepted where the container:
 
• Has been materially altered or modified
 
• Has been structurally changed
 
• Has been permanently installed or incorporated into another structure
 
• Has been materially damaged after delivery
 
• Cannot reasonably be collected because of conditions created by the customer
 
• Is otherwise outside the eligibility conditions of this policy
 
These exclusions apply only to voluntary change of mind returns and do not affect rights available under the Australian Consumer Law.
 

15.Customer Responsibilities

For orders and returns, customers are responsible for:

• Providing accurate delivery and contact information.

• Ensuring the delivery location is suitable and accessible.

• Inspecting the container upon delivery.

• Taking reasonable care of the container after delivery.

• Keeping the container in substantially the same condition if requesting a change of mind return.

• Providing accurate information when requesting a return.

• Ensuring suitable access for heavy transport collection.

• Paying the reasonable return or collection costs applicable to an eligible change of mind return.

• Understanding that the original delivery fee paid for an eligible change of mind return is non-refundable, except where otherwise required by law.

Customers should not modify, relocate, permanently install or otherwise alter a container they intend to return without first contacting us.

16. Return Approval
 
All change of mind returns require prior approval.
 
Once a return request is received, we will assess the request against the conditions of this policy and provide the customer with the applicable return instructions.
 
Customers should not independently arrange transport to return a container without first contacting us.
