Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded, restricted or modified under the Australian Consumer Law (ACL). 3. Products
We sell shipping containers and related products and services through our website.
Our available products include:
Standard shipping containers (New One-Trip, Used, Refurbished, Cargo Worthy, Wind & Watertight)
Refrigerated shipping containers (Reefers)
Insulated shipping containers
Office containers, site office containers, offshore containers, and custom modified/converted units
Product availability depends on current stock and other relevant supply and delivery conditions.
Product pages may include information such as:
Container type
Dimensions
Condition
Features
Availability
Photographs
Price
Delivery information
We make reasonable efforts to ensure product information is accurate and current.
However, shipping containers, particularly used or refurbished containers, may have reasonable variations in:
Colour
Surface appearance
Minor cosmetic marks
Paint condition
Minor dents or scratches
Other characteristics consistent with their stated condition
Where a product is advertised as used, refurbished or in a particular condition, customers should carefully review the product description and photographs before placing an order.
Where photographs are representative rather than photographs of the exact unit, this should be indicated in the relevant product listing.
If a product has a material defect or is significantly different from its description, your rights under the Australian Consumer Law continue to apply.
4. Product Availability
All products are subject to availability.
Product availability displayed on the website may change before an order is confirmed.
If a product becomes unavailable after an order has been placed and we cannot reasonably fulfil the order, we will contact you and provide an appropriate solution, which may include a refund where applicable.
A product enquiry or modification quote request does not guarantee that the relevant product will remain available.
5. Product Prices
All prices displayed on our website are in Australian Dollars (AUD) unless otherwise stated.
The applicable product price will be displayed on the relevant product page and during checkout.
AGM is currently not registered for GST. Accordingly, GST is not charged on our current sales while AGM remains unregistered.
Where applicable, delivery or transportation charges will be separately disclosed before the customer completes the purchase.
We take reasonable steps to ensure that pricing and product information displayed on our website is accurate. However, occasional pricing, typographical, technical or listing errors may occur.
If we identify a genuine pricing or listing error affecting an order, we will contact you as soon as reasonably practicable and explain the available options before proceeding with the affected order.
If an order is cancelled because of a genuine pricing or listing error and payment has already been received, the amount paid for the affected order will be refunded, subject to applicable law.
Nothing in this section is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law.
6. Product Enquiries and Modification Quote Requests
Our website provides product enquiry functionality that allows customers to ask questions about specific products and request a modification quote.
Customers may submit an enquiry through our WordPress product enquiry functionality. The enquiry form may request information including:
Name
Email address
Phone number
Subject, where provided
Enquiry or message
Information identifying the product associated with the enquiry
Other information voluntarily provided by the customer
The product associated with an enquiry may be identified through the product page or information displayed in the enquiry form.
Product enquiries and modification quote requests are provided free of charge.
AGM reviews product enquiries and modification quote requests manually. We generally respond to enquiries by email using the contact information provided by the customer.
The information submitted through the enquiry functionality is directed to our business email address:
Submitting a product enquiry or requesting a modification quote:
Does not automatically create an order.
Does not automatically create a purchase contract.
Does not guarantee product availability.
Does not guarantee that a requested modification is available or technically possible.
Does not confirm that a requested modification has been approved.
Does not require payment merely to submit the enquiry.
We may request additional information before determining whether a requested product, modification or delivery arrangement is available.
Where the enquiry form displays terms or conditions that must be acknowledged before submission, customers should review those terms before submitting the enquiry.
7. Quotes, Pricing and Modifications
Any pricing, availability, modification details, delivery information or other information provided in response to a product enquiry or modification quote request is subject to confirmation.
Where AGM provides a quote, the relevant product or proposed modification, applicable pricing, delivery information and any relevant conditions may be communicated to the customer by email.
A product enquiry or modification quote request is not, by itself, an accepted order or binding agreement to supply a product or carry out a modification.
Before an order or modification is accepted, AGM may need to confirm:
The product or container involved
The requested modification
Whether the requested modification is available and suitable
The applicable price
Delivery arrangements
Any additional requirements or conditions
The applicable payment arrangements
A binding agreement will be formed only in accordance with the applicable offer, acceptance and purchase arrangements.
Any quote may be subject to conditions or further confirmation communicated to the customer. Where a quote includes a specific validity period, the applicable period will be stated in the quote or accompanying communication.
Nothing in this section limits any rights or remedies available to customers under the Australian Consumer Law.
8. Product Modifications
Customers may request information or a quote for a proposed modification to a product through our product enquiry functionality.
A modification request must be reviewed by AGM before it can be accepted.
AGM may need to assess the requested modification, the product’s characteristics, suitability, availability, technical requirements and any applicable costs.
A modification request does not guarantee that the modification:
Is available.
Is technically possible.
Is suitable for the product.
Has been approved.
Can be completed within a particular timeframe.
Can be completed at the customer’s requested price.
Any approved modification, applicable price, delivery arrangement and other relevant conditions should be confirmed before the customer proceeds with the purchase or modification.
A modification enquiry alone does not confirm that AGM has agreed to carry out the requested work.
9. Orders
When you place an order through our website, you agree that:
The information you provide is accurate and complete.
You have authority to use the payment method provided.
You have reviewed the product description and relevant purchase conditions.
You have provided accurate delivery information.
You have reviewed our Shipping & Delivery Policy and Returns & Refund Policy .
Submitting an order constitutes an offer to purchase the selected product.
An order is not considered accepted until we confirm the order and are able to fulfil it.
A product enquiry or modification quote request is separate from an order and does not automatically constitute an offer to purchase unless expressly stated otherwise.
We may contact you to verify information relating to an order where reasonably necessary.
10. Order Acceptance and Cancellation
We reserve the right to decline or cancel an order where reasonably necessary, including where:
The product is unavailable.
There is a genuine pricing or product-description error.
We are unable to verify information reasonably necessary to fulfil the order.
The transaction appears fraudulent or unauthorised.
Delivery to the specified location cannot reasonably be completed.
An error has occurred in the ordering or payment process.
If we cancel an order after payment has been received and no other remedy is applicable, we will arrange a refund of the amount paid for the cancelled order.
Nothing in this section limits any rights or remedies available to consumers under the Australian Consumer Law.
11. Payment
The payment methods available for your order will be displayed during the checkout process.
Customers must provide accurate and valid payment information and must be authorised to use the selected payment method.
Payment must be successfully authorised or received before an order is processed, unless an alternative payment arrangement has been expressly agreed with AGM.
We may use third-party payment providers to process payments. Payment processing may be subject to the terms and conditions of the applicable payment provider.
We do not ordinarily have access to customers’ full payment-card details where those details are processed directly by third-party payment providers.
Further information about accepted payment methods, payment processing and related conditions is available in our Payment Policy .
12. Delivery
Shipping containers require transportation and delivery arrangements that may vary depending on the type, size, condition and components of the container purchased.
Delivery may depend on:
Delivery location
Container type, size and weight
Road conditions
Site accessibility
Available transport equipment
Local restrictions
Weather conditions
Customer availability
Requirements for transporting refrigerated or insulated containers
Other circumstances affecting transportation
Delivery for standard, refrigerated and insulated shipping containers is subject to product availability, delivery location, transportation requirements and access conditions.
Estimated delivery dates or timeframes are provided as estimates and may change because of circumstances outside our reasonable control.
Any applicable delivery fees, additional transportation costs or special handling charges should be communicated to the customer before they are charged, where applicable.
For complete delivery information, please review our Shipping & Delivery Policy .
13. Delivery Site Requirements
Before delivery, customers are responsible for ensuring that the delivery location is suitable and reasonably accessible for the required transport equipment.
Customers should ensure:
There is sufficient access for the delivery vehicle.
Roads and entrances are suitable for the required vehicle.
There is sufficient clearance for the container and delivery equipment.
The delivery area is reasonably level and suitable for placement.
Any required permissions or site approvals have been obtained.
No obstruction prevents safe delivery.
If delivery cannot reasonably be completed because of inaccurate information, inadequate access or conditions at the delivery site, additional transport or attempted-delivery costs may apply where permitted and disclosed.
We may need to reschedule delivery where the site is unsafe or inaccessible.
14. Inspection on Delivery
Customers are encouraged to inspect the container and any supplied components promptly upon delivery and, where reasonably practicable, before the delivery vehicle leaves the site.
Refrigerated & Insulated Units: Customers should inspect refrigerated containers upon delivery, including the available electrical connections, display panels and refrigeration equipment. Insulated containers should be checked for visible panel condition and door seal condition.
Delivery Documentation: Customers may be asked to sign the delivery docket or other transport documentation to acknowledge delivery. Customers should note any visible damage, discrepancy or other issue on the delivery documentation where possible.
Discrepancies or Delivery Issues: If a delivered container appears damaged, materially differs from the product ordered, or has an issue that is apparent upon delivery, customers should notify AGM as soon as reasonably practicable and provide relevant evidence, such as photographs, videos and delivery documentation.
Further information regarding container types, condition standards, inspection and applicable remedies is provided in our Container Types, Quality & Inspection Standards policy.
Failure to report an issue within a particular period does not automatically remove or reduce any rights or remedies available to the customer under the Australian Consumer Law.
15. Returns and Refunds
Our 30-day change-of-mind return policy applies to eligible purchases subject to the conditions set out in our Returns & Refund Policy .
Due to the size and weight of shipping containers, approved returns require specialised transportation.
The Returns & Refund Policy explains:
The 30-day return period.
Return eligibility.
Return transportation requirements.
Return shipping costs.
Refund processing.
Faulty or damaged products.
Exchanges and replacements.
Australian Consumer Law rights.
Customers should review the Returns & Refund Policy before placing an order.
Nothing in these Terms or our Returns & Refund Policy limits consumer guarantees or other rights that cannot legally be excluded under Australian law.
16. Warranty
Eligible shipping containers are covered by AGM’s applicable commercial Warranty Policy, subject to the relevant warranty period, coverage terms, eligibility requirements and exclusions.
Our product range may include:
- Standard shipping containers
- Refrigerated shipping containers
- Insulated shipping containers
- Specialised, office, offshore and modified or converted containers
The warranty coverage applicable to a particular container depends on the container, its condition, the components or features supplied with it, and the applicable terms of the Warranty Policy.
For refrigerated shipping containers, the applicable commercial warranty may cover eligible defects affecting the container and refrigeration equipment supplied with it, including the refrigeration machine, cooling system, electrical controls and other covered refrigeration-related components, subject to the Warranty Policy.
For insulated shipping containers, the applicable commercial warranty may cover eligible defects affecting the container and the insulated panels and other covered insulation-related components supplied with it, subject to the Warranty Policy.
For specialised, office, offshore and modified or converted containers, warranty coverage applies only where the particular container, components or features are eligible under the applicable Warranty Policy. Coverage may vary depending on the individual container and its configuration.
The applicable warranty period depends on the condition and eligibility of the container and is stated in our Warranty Policy.
The commercial warranty does not cover problems caused by normal wear and tear, misuse, improper maintenance, accidental damage, unauthorised modifications or other exclusions stated in the Warranty Policy.
The commercial warranty operates in addition to any rights and remedies available to customers under the Australian Consumer Law.
Nothing in these Terms or the Warranty Policy limits any rights that cannot legally be excluded, restricted or modified.
For complete warranty details, including coverage, exclusions, warranty periods, eligibility and claim requirements, please review our Warranty Policy.
17. Australian Consumer Law
- Operate separately from our voluntary 30-day change-of-mind return policy.
- Operate separately from our 48-hour delivery inspection and defect reporting procedure outlined in our Container Types, Quality & Inspection Standards policy.
Where a container is advertised as used, refurbished or in a specified condition, the product description and photographs should be reviewed carefully before purchase.
Used or refurbished containers may show reasonable signs of prior use, including:
Cosmetic marks
Dents
Scratches
Paint variations
Surface rust
Other characteristics consistent with their advertised condition
The condition of individual containers may vary.
Refrigerated and insulated containers may also have additional components or features specific to the product purchased.
We will not intentionally misrepresent the condition or characteristics of a product.
Where a condition or defect is specifically disclosed before purchase, it will be considered when assessing a change-of-mind return, subject to applicable law and our Returns & Refund Policy.
This does not affect rights arising from a product failing to meet applicable consumer guarantees.
19. Images and Product Appearance
Product images are provided to help customers understand the product being offered.
Actual product appearance may vary slightly due to:
Lighting
Photography conditions
Screen settings
Natural variation
Product condition
Minor differences between individual units
For used and refurbished containers, the actual appearance may include reasonable variations in colour, paint condition, surface marks, minor dents, scratches or other characteristics consistent with the advertised condition.
For refrigerated and insulated containers, the photographs and product description should be reviewed to understand the specific equipment, components and condition of the product being offered.
Where an individual container is shown in photographs, customers should understand that the actual unit supplied may have reasonable variations if the listing states that the photographs are representative rather than photographs of the exact unit.
